Fort Never is an independent music project from Austin, Texas. Our website, fortnever.com (the “Site”), is where we share our music, videos, merch, services, and a journal about songwriting, production, gear, and life in the Austin music scene. This Disclaimer explains the limits of what you can rely on when you read or use the Site. It works alongside our Terms & Conditions and Privacy Policy.
1. General information only
Everything on the Site is published in good faith for general information and entertainment. We are musicians, not a newsroom or a professional advisory service. We try to keep information accurate and current, but we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, or suitability of any information on the Site for any particular purpose.
Any action you take based on information you find here is strictly at your own risk. Fort Never will not be liable for any loss or damage arising from your use of, or reliance on, the Site’s content, to the fullest extent permitted by law.
2. Journal articles are not professional advice
Our journal covers topics such as recording and mixing techniques, drum machines and live drums, songwriting, hearing protection for musicians, the history of genres like trip-hop, and getting around the Austin music scene. These articles reflect our experience and our reading. They are not a substitute for advice from a qualified professional who knows your circumstances.
- Not medical advice. Articles that touch on hearing, vocal health, posture, injuries, stress, or wellbeing are general information. They do not diagnose, treat, or prevent any condition. If you have symptoms such as ringing in your ears, muffled hearing, pain, or voice problems, see a doctor, an audiologist, or another licensed health professional.
- Not legal advice. Articles that mention copyright, contracts, publishing, royalties, performing rights organizations, sampling, or licensing are simplified overviews. Music law is complicated and varies by country and situation. For decisions that matter, talk to a licensed attorney.
- Not financial or tax advice. Anything we say about budgeting for gear, pricing gigs, streaming income, or running a music project as a business is our perspective, not financial, investment, accounting, or tax advice. Consult a qualified accountant or financial adviser.
- Not technical or safety certification. Tips about wiring, power, speakers, studio electronics, or stage setups are offered as general guidance. Always follow the manufacturer’s instructions, local electrical codes, and venue rules, and use a qualified technician when in doubt.
Reading the Site or contacting us does not create any professional, advisory, or client relationship. If we provide a paid service, such as a production or mixing session, the terms of that service are set out separately in our Terms & Conditions and booking confirmation.
3. Hearing safety
We make music to be heard, and we want you to keep hearing it for a long time. Loud sound can permanently damage your hearing, and that damage builds up over time without hurting. Please keep these general points in mind:
- The risk depends on both loudness and time. For example, the U.S. National Institute for Occupational Safety and Health (NIOSH) recommends limiting exposure to 85 decibels (A-weighted) to about eight hours, and the safe time is cut roughly in half for every 3 dB increase.
- Concerts, clubs, rehearsal rooms, and headphones at high volume can exceed those levels, sometimes by a wide margin.
- Use earplugs at shows and rehearsals. Musician’s earplugs with flatter filtering can reduce volume while keeping the sound more natural.
- Keep headphone and earbud volume moderate, take listening breaks, and consider noise-cancelling headphones so you are not turning up the music to cover background noise.
- Ringing in the ears (tinnitus) or muffled hearing after loud exposure is a warning sign. If it lasts or keeps happening, see an audiologist or doctor.
Turn the volume down before you press play on any music or video on the Site, especially with headphones. You are responsible for choosing a safe listening level. These points are general information, not medical advice.
4. External links
The Site links to websites and services we do not own or control, such as streaming platforms, social media, venues, equipment makers, news articles, and other musicians. We include links because we think they may be useful or interesting, but we do not review every page on those sites, and their content can change after we link to it.
A link does not mean we endorse the site, its owner, or its products. We are not responsible for the content, accuracy, availability, privacy practices, or security of any external site. Please read the terms and privacy policy of any site you visit from ours. If you find a broken or inappropriate link, let us know at [email protected].
5. Affiliate links, sponsorships, and endorsements
At the time of writing, Fort Never does not participate in any affiliate programs and does not receive payment, free products, or other compensation for mentioning products, brands, services, or venues on the Site. When we name a piece of gear, a plugin, an app, or a place, it is because we use it, like it, or think it is relevant, not because anyone paid us.
If that changes, we will clearly disclose any affiliate link, sponsorship, gifted product, or other material connection next to the content it relates to, consistent with the U.S. Federal Trade Commission’s guidance on endorsements. We will also update this page.
6. Errors, omissions, and changes
We are a small project, and mistakes happen. The Site may contain typos, outdated details, or inaccuracies, including in product descriptions, prices, availability, technical specifications, dates, and historical or background information in our journal. Information about third-party businesses, such as venue details, opening hours, or product features, can change without notice, so please confirm it with the source before relying on it.
We may correct errors, update information, or remove content at any time without notice, but we have no obligation to keep any particular content current. If you spot something wrong, we would genuinely like to hear about it.
7. Views expressed
Journal articles and posts express the opinions of the person who wrote them at the time of writing. Opinions can change, and they are not statements of fact about other people, brands, or organizations. Views expressed by guests, collaborators, or commenters belong to them and do not necessarily reflect the views of Fort Never or its members.
Any civic or community content on the Site, such as encouragement to register to vote or take part in local events, is nonpartisan. It does not endorse any political party, candidate, or campaign.
Comments posted by visitors are not reviewed in advance. We may remove comments that break our Terms & Conditions, but we are not responsible for what others post.
8. Embedded content
Some pages include music and video embedded from third-party platforms such as YouTube, Spotify, and SoundCloud. To protect your privacy, these embeds load only after you click the “load” placeholder. Once loaded, the embedded player is provided by that platform. Its availability, playback quality, advertising, recommendations, and data practices are controlled by the platform, not by us.
Embedded content behaves as if you visited the platform directly, and the platform may collect data about you and set cookies. See our Privacy Policy and Cookie Policy for details. We are not responsible if an embed is removed, blocked in your region, or changed by the platform.
9. “As is” and limitation of liability
The Site and all its content are provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, timely, secure, or free of errors, viruses, or other harmful components, or that defects will be corrected.
To the fullest extent permitted by law, Fort Never and its members will not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your access to or use of the Site or its content, or your reliance on any information on it. Some jurisdictions do not allow certain warranty exclusions or liability limits, so parts of this section may not apply to you. Nothing in this Disclaimer limits any liability that cannot be limited under applicable law. The fuller limitation of liability in our Terms & Conditions also applies.
10. Changes to this Disclaimer
We may update this Disclaimer from time to time. The “Last updated” date at the top of the page shows when it was last revised. Continuing to use the Site after changes are posted means you accept the updated version.
